What Is My Case Value?

Each case value is dependent upon the facts, damages and injuries.  In order for you to determine value, there is a formula or a math equation method.  Instead, look at the following six factors as important to determining the value of any case.

1. Were you seriously injured?

A serious injury is usually described as broken bones, disk injury in your neck or back, head injury, knee derangement, shoulder derangement, or other orthopedic injuries.  These types of injuries tend to settle for greater amounts than an injury that takes two to four weeks to heal.  These factors increase the value as time to recover increases.

2. Was there a significant impact causing the injury?

Sometimes people claim that they are injured in an impact but the jury is doubtful that an injury like the one they are claiming could have occurred because there’s no damage or very little damage to the car.  In these kinds of instances, subtle investigation needs to be conducted to determine exactly what damage occurred and why.

3. Was there a wage lost and was it justifiable?

Many people believe that if you are involved in an accident, you should just simply take off of work just to “pad the case.” The fact of the matter is, it’s better for you to work when you can, but take off when you cannot.  A doctor’s prescription for you to be off work is probably recommended.  Additionally, remember that when you take off time from work, ultimately it’s a zero sum gain.  That is, you are only going to recover the amount that you would have received had you gone to work.  So why risk wage loss if you feel you can safely work.

4. Are you going to suffer from permanent disability?

Permanent disability is the prediction of pain or symptoms that continue to plague you long after the case has been concluded.  Permanent disability substantially increases the value of your case, and includes such things as the pain and suffering you are likely to endure for the balance of your life. However, speculation is not enough.  A doctor usually has to be willing to predict long term affects from an accident.

5. Are you going to have to visit the doctor more often than normal in the future, because of the accident?

Future medical expenses increase the claim value.

6. Intangibles.

Intangibles are those interruptions in life that are significant. An example, your claim will have more value if you were traveling to your wedding day on the day of the accident, of you lost the sight of your only god eye.
